GuestBrain Terms & Conditions

GuestBrain is an AI SaaS platform developed and operated by GARCIA&MAISEL to automate marketing, communications and guest management for independent hotels. These terms govern the access to and use of www.guestbrain.io and the GuestBrain service.

The service is contracted by hotels or tourism establishments. Each hotel is responsible for the guest information it uploads or syncs and for obtaining the necessary consents for communications.

User accounts are created by the hotel client or by GARCIA&MAISEL. Users must keep their credentials confidential and notify any unauthorized use immediately.

GuestBrain, its code, design, brands and content are property of GARCIA&MAISEL. The client may not copy, modify or distribute the software without authorization.

Price, billing and renewal conditions are agreed in the corresponding contract or order. GARCIA&MAISEL may modify prices with prior notice.

GARCIA&MAISEL does not guarantee specific revenue or booking outcomes. The service is provided "as is" and liability is limited to the amount paid for the service in the previous 12 months, unless applicable law prevents such limitation.

GARCIA&MAISEL may suspend or cancel the service for breach of these terms, misuse or non-payment. The client may request cancellation as agreed.

These terms are governed by the laws of the State of South Carolina, United States, without prejudice to mandatory data protection rules applicable to European residents.

GARCIA&MAISEL may update these terms. We will publish the date of the last update at the top of the document.
